The Kinsa case: an opportunity to dismantle the criminalisation of migration
in collaboration with circolo ARCI Porco Rosso and Clinica Legale Roma Tre
In 2019, a woman from Congo was arrested for crossing the border with her underage daughter and granddaughter on charges of aiding and abetting irregular migration. The case became a landmark litigation, emblematic of the fight against the criminalisation of freedom of movement. After making history at the Constitutional Court, it now reaches the Grand Chamber of the Court of Justice of the European Union, which is called upon to assess the compatibility of Italian and European legislation criminalising freedom of movement with the Charter of Fundamental Rights of the European Union.
We will analyse from the Kinsa case the different ways in which Italian law criminalises freedom of movement and who promotes it – from people arrested as smugglers to members of NGO search and rescue crews. Together, we will trace the opportunities that open up and the obstacles to overcome in our common struggle.
